Jack and Casey He's custody fight has a new turn


In 1998, Jack He was a graduate assistant at the University of Memphis when he was accused by a student of sexual assault. That nightmare is still haunting him even though he finally was exonerated on February 21, 2003, some five years later. So much for his constitutional right to a speedy trial.

Because of that case, he has lost his job at the University, his degree and most preciously, his daughter, Anna Mae (a.k.a. He Mei), to her foster parents, Jerry and Louise Baker. At a court hearing on September 4, 2003, Judge Alissandratos refused to grant the two motions filed by the Hes: motion for a jury trial and motion for bifurcating abandonment & best interest issues. As a result, a bench trial was scheduled to begin on September 29th; however, the judge delayed the case indefinitely when court convened. The Hes face a deportation hearing on December 17th. So they do not have much time. In the meantime, the Hes are barred by the judge to have any contact with Anna Mae.

On November 14, 2003, Judge Alissandratos surprised everyone by recusing himself in the middle of a hearing. This appears to be an early Christmas gift for the Hes. Stay tune. (Guy M. Wong)
